Terms of Use

These Terms of Use ("Terms") govern your use of the Buka platform operated at buka.app ("Platform", "Service"), provided by Buka ("we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms.
1. 1. Service Description
Buka is a WhatsApp-native booking and queue management platform that enables:
- Service Providers to manage appointments, walk-in queues, staff schedules, and client relationships through a web-based dashboard
- Customers to book appointments, join queues, and receive updates via WhatsApp, Facebook Messenger, Instagram, and SMS
Buka facilitates the connection between service providers and customers but is not a party to any service agreement between them.
2. 2. Eligibility
- You must be at least 18 years of age to use the Platform
- Service providers must be legally authorised to operate their business in Botswana
- You must provide accurate and complete registration information
3. 3. Account Responsibilities
3.1 Service Providers
- You are responsible for maintaining accurate business information (services, pricing, hours)
- You are responsible for responding to bookings and managing your schedule
- You must not use the Platform to send spam or unsolicited messages
- You are responsible for all activity under your account
- You must keep your login credentials secure
3.2 Customers
- You must provide accurate contact information when booking
- You should honour confirmed appointments or cancel with reasonable notice
- You must not misuse the queue system (e.g., joining queues without intending to visit)
4. 4. Subscription Plans and Payment
4.1 Plans
Buka offers the following subscription tiers:
- Motho (Free): Limited features, 30 bookings/month
- Kgwebo (P79/month): Unlimited bookings, reminders, directory listing
- Kgwebo+ (P199/month): All channels, advanced features, 10 staff accounts
- Enterprise (Custom): Multi-branch, unlimited everything, SLA guarantees
All prices are in Botswana Pula (BWP) and inclusive of applicable taxes.
4.2 Payment
- Paid subscriptions are billed monthly or annually in advance
- We accept Orange Money, MyZaka, and card payments
- If payment fails, your account enters a grace period. If not resolved, your account will be downgraded to the free plan
4.3 Cancellation
- You may cancel your subscription at any time from your dashboard
- Cancellation takes effect at the end of the current billing period
- You retain access to paid features until the period ends
- No refunds are provided for partial billing periods
5. 5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Send spam, unsolicited messages, or marketing through the booking system
- Attempt to access other users' accounts or data
- Interfere with or disrupt the Platform's infrastructure
- Scrape, crawl, or extract data from the Platform without permission
- Upload malicious content or code
- Impersonate another person or business
- Use the Platform to discriminate against customers based on protected characteristics
6. 6. Intellectual Property
- The Bukanako name, logo, and brand assets are our intellectual property
- The Platform software, design, and documentation are protected by copyright
- Service providers retain ownership of their business content (descriptions, images, pricing)
- By using the Platform, you grant us a licence to display your business information in the directory and through WhatsApp messages
7. 7. Directory and Reviews
- Service providers with qualifying plans may appear in the Buka discovery directory
- Customer reviews are displayed publicly and must be honest and based on actual experiences
- We reserve the right to remove reviews that are abusive, fraudulent, or violate these Terms
- Service providers may respond to reviews through their dashboard
8. 8. WhatsApp and Third-Party Services
Buka integrates with third-party services including:
- Meta WhatsApp Business Platform — for messaging. Subject to WhatsApp's Terms of Service
- Google Calendar / Microsoft Outlook — for calendar sync (optional)
- Payment providers — for subscription billing
Your use of these third-party services is also governed by their respective terms and policies.
9. 9. Limitation of Liability
- Buka is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service (except as specified in Enterprise SLA agreements)
- We are not liable for disputes between service providers and customers
- We are not liable for lost revenue due to service interruptions, missed bookings, or technical issues
- Our total liability is limited to the amount you paid for the Platform in the 12 months preceding the claim
10. 10. Suspension and Termination
- We may suspend or terminate your account if you violate these Terms
- We may suspend accounts with overdue payments after the grace period
- Upon termination, you may request export of your data within 30 days
- We reserve the right to discontinue the Platform with 90 days' notice
11. 11. Modifications
We may update these Terms from time to time. We will notify you of material changes via email or WhatsApp at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
12. 12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Botswana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Botswana.
